Please read these Terms of Service carefully before using Herstia. By creating an account or using the Service, you agree to be bound by these terms.

1. About Herstia

2. Eligibility

• The Service is intended for use by individuals in the United Kingdom
• By creating an account, you confirm that the information you provide is accurate

3. Your Account

Herstia uses Google OAuth and magic link email authentication — no password is required. You are responsible for:

• Keeping access to your registered email account and Google account secure
• All activity that occurs under your Herstia account
• Notifying us immediately at hello@herstia.com if you suspect unauthorised access

We reserve the right to suspend or terminate accounts that violate these Terms.

4. The Service

Herstia provides tools to help you manage and understand home maintenance tasks, including a task log, photo upload and storage, and AI-generated diagnosis and guidance powered by Anthropic's Claude API.

The Service is provided 'as is'. We do not guarantee uninterrupted availability and may update, modify, or discontinue features at any time.

5. AI-Generated Guidance — Important Limitations

• AI responses are generated automatically based on the information and photos you provide. They may not be accurate, complete, or appropriate for your specific situation.
• For any issue involving electrical systems, gas, structural integrity, or anything you believe may pose a safety risk, you must seek a professional assessment regardless of what the AI suggests.
• Do not delay seeking professional help based on AI guidance alone.

We expressly disclaim all liability for any loss, damage, injury, or cost arising from reliance on AI-generated guidance. Use of the AI features is entirely at your own risk.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Upload content that is offensive, defamatory, or infringes any third-party rights
• Attempt to reverse engineer, scrape, or interfere with the Service or its infrastructure
• Share your account with others or attempt to access another user's account

7. Your Content

You retain ownership of the content you upload to Herstia, including task descriptions and photos. By uploading content, you grant us a non-exclusive, royalty-free licence to store, process, and transmit that content as necessary to provide the Service.

You are responsible for ensuring you have the right to upload any content you submit.

8. Subscription and Pricing

Herstia currently offers a free tier with a limited number of AI analyses. A paid Herstia Pro subscription is planned for future release. Any pricing and billing terms will be communicated clearly before any payment is taken. No charges will be made without your explicit consent.

9. Intellectual Property

All intellectual property rights in the Herstia Service — including the software, design, branding, and content we produce — belong to us or our licensors. Nothing in these Terms grants you any rights to use the Herstia name, logo, or branding without our prior written consent.

10. Limitation of Liability

To the fullest extent permitted by English law:

• We shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Service
• Our total liability for any claim shall not exceed the amount you have paid us in the 12 months preceding the claim (or £50 if no payments have been made)
• We do not exclude liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under English law

11. Termination

You may delete your account at any time from within the app — all your data will be permanently deleted. We may suspend or terminate your access if we reasonably believe you have violated these Terms, with reasonable notice where practicable.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the 'Last updated' date and, where appropriate, by email. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
